What the Law Says About Mutilating Coins The section of federal law that makes mutilating coins a crime is Title 18, Section 331, which reads: Whoever fraudulently alters, defaces, mutilates, impairs, diminishes, falsifies, scales, or lightens any of the coins coined at the mints of the United States, or any foreign coins which are by law made current or are in actual use or circulation as money within the United States; or whoever fraudulently possesses, passes, utters, publishes, or sells, or attempts to pass, utter, publish, or sell, or brings into the United States, any such coin, knowing the same to be altered, defaced, mutilated, impaired, diminished, falsified, scaled, or lightened shall be fined under this title or imprisoned not more than five years, or both. A separate section of Title 18 makes it illegal to debase coins minted by the U.S. government, meaning to shave some of the metal off and make the money less valuable. That crime is punishable by fines and up to 10 years in prison. Prosecutions Are Rare for Mutilating Currency Its pretty rare for someone to be arrested and charged with defiling or debased U.S. currency. Even those penny press machines found at arcades and some seashore attractions are in compliance with the law because theyre used to create souvenirs and not to debase or shave metal off the coin for profit or fraud. Perhaps the highest profile case of currency mutilation dates to 1963. An 18-year-old U.S. Marine named Ronald Lee Foster was convicted of whittling away the edges of pennies and spending the 1 cent coins as dimes in vending machines. Foster had been sentenced to a year of probation and $20, but more seriously the conviction prevented him from being able to get a gun license. Foster made national news in 2010 when President Barack Obama pardoned him.

Interest in environmental protection and sustainable development has beenincreasing year by year. To meet the challenges, an Environmental ManagementSystem (EMS) is implemented. An EMS is a continuous cycle of planning,implementing, reviewing and improving the processes and actions that anorganisation undertakes to meet its environmental obligations. The worlds firststandard for environmental management systems (EMS) BS 7750 was developed andpublished by the British Standards Institution (BSI) in 1992. This later formed the basis for the ISO 14000, which was developed by the International Organisation for Standardisation (ISO). In 1996, ISO 14001 which establishes the requirements for an EMS was finalised. Implementation of an EMS can improve environmental performance, reduced liability, competitive advantage, reduced costs, fewer accidents, employee involvement, compliance performance, enhance management confidence, increase efficiency, improve public image, enhance customer trust, meet customer requirements and growth management. Thekey to effective environmental management is the use of a systematic approachto planning, controlling, measuring and improving an organisationsenvironmental performance. Common aspects of an EMS are environmental policy,adequate resources, responsibilities and authorities, training, systemdocumentation, operational controls, document control, system audits andmanagement review. Most EMS models are based on the concept of Plan, Do,Check, Act model introduced by Shewart and Deming which emphasises the conceptof continual improvement. Someof the important EMS elements in common EMS models are discussed in detail.Most of the EMS components are inter-related (given in fig 1). The firstelement is the environmental policy, which is the top managementsdeclaration of its commitment to the environment. The environmental policy servesas a foundation and vision of environmental concern by the entire organisation.The policy should relate to the companys products and services, be simple,understandable, and explicit enough to be audited. The policy is relevant tocontinual improvement, pollution prevention and compliance with relevant lawsand regulations. Thesecond element is the identification of environmental aspects which arethe organisations activities, products, or services that can interact with theenvironment. These environmental aspects , which are called as significantenvironmental aspects, determine the environment objectives to beestablished and operational controls and actions defined later. Theenvironmental aspects are essential to establish positive impacts on thebottom line and providing environmental improvements. Legal and other requirements of the EMS may include federalrequirements, state and local requirements, standards in locations in which thecompanys products/services are sold and permit conditions. These requirementsshould be factored into the organisations management efforts to avoidpotential costs as non-compliance can cause possible damage to the environment,revenue loss and impact on public image. Objectives and targets establish environmental goals for theorganisation in line with company policy, environmental policy, environmentalimpacts, the views of interested parties and other factors. This is essentialto help an organisation translate purpose into action. Various EMS implementationprojects for small and medium-sized companies indicate that it is best to startwith a limited number of objectives and expand the list over time. Measurementof progress of achieving targets should be determined. An Environmental Management Program is developed byplanning to achieve objectives. Targets should be set by definingresponsibilities for achieving goals and means and time frame for achievingthem. Therefore, an Environmental Management Program acts as a road map/actionplan for achieving environmental goals. Re-evaluation of the action plan andfocus in continual improvement should be made. Structureand responsibility defines effective roles and responsibilities and ensuresthat the top management provide resources including human resources,specialised skills, technology, and financial resources. Small and medium-sizedorganisations may have advantages over large ones in structuring theirresources for environmental management as resource being limited; people haveexperience in performing multiple functions. Structure and responsibility isneeded for an EMS to live up to its full potential. Training,awareness and competency are important for awareness, motivation,commitment, skills/capability, compliance and performance as every employee canhave potential impacts on the environment by generating good ideas forimprovement. Training should be conducted and tracked and its effectivenessevaluated. Establishment of internal and external communications onenvironmental management issues for neighbours, community groups, otherinterest groups, local officials, regulatory agencies and emergency respondersshould be effected to maintain the flow of useful and required information.Effective communication can help to motivate workforce, gain acceptance for thecompanys plans and efforts, explain the companys environmental policy, ensureunderstanding of roles and expectations, demonstrate management commitment,monitor and evaluate performance and identify potential system improvements. EMSdocumentation by maintaining information on EMS and related documentsshould be done to provide adequate information to the people involved in thesetting up of the EMS and also to external parties like customers, regulators,lending institutions, registrars and the public for better understanding. Documentcontrol is a mechanism providing up-to-date procedures, instructions andother documents to ensure effective management of procedures and other systemdocuments . It ensures that people are consistently performing in the rightway. It is linked with EMS documentation, operational control and records. Operationalcontrol is effected by identifying, planning and managing operations andactivities in line with company policy, objectives and targets which includedocumented procedures to manage environmental policy, significant environmentalaspects, objectives and targets and legal and other requirements. It ensuresthat the commitments of the environmental policy is satisfied and preventdeviations from the policy. Operational control is also needed to managesignificant aspects or legal requirements. Emergency preparedness and response is to be maintained to reduceinjuries, prevent or minimize environmental impacts, protect employees andneighbours, reduce asset losses and minimize downtime. It serves as a tool todetermine whether more training and revision of emergency plans and proceduresis needed. Monitoringand measurement of key activities and performance is essential to evaluateenvironmental performance, analyse root causes of problems, assess compliancewith legal requirements, identify areas requiring corrective action, improveperformance and increase efficiency. In general, is serves as an assessment ofhow well the system is performing and helps to manage the organisation better.Monitoring is done effectively when current and reliable data is available byproper EMS documentation and Document control. Non-conformance and corrective and preventive action is essentialto identify and investigate problems, identify root causes, identify andimplement corrective and preventive actions and make sure actions are trackedand their effectiveness verified. Most EMS problems are identified by internalauditors by accessing information from operation control and monitoring andmeasurement. Records are essential to demonstrate the actual implementation ofthe EMS designed. Records have value internally as well as over time when thereis a need to provide evidence to external parties such as customers, aregistrar or the public. Accurate records is also essential for a system tooperate consistently. Virtually every element of the EMS can result in thegeneration of records as it is inter-linked. An EMS audit is a systematic and documented verification processof objectively obtaining and evaluating evidence to confirm whether anorganisations environmental management system conforms to the environmentalmanagement system audit criteria set by the organisation. In a smallerorganisation, periodic audits can be particularly valuable as managers close tothe work may not often see the problems or insufficient procedures that have beendeveloped. Management review is the key to continual improvement and forensuring that the EMS will continue to meet the organisations needs over time.They also offer a great opportunity to keep the EMS efficient and costeffective. Smaller organisations often favour employee experience over writtenprocedures and documented systems. However, personnel turnover withoutdocumented systems can stall progress. On establishment of an EMS, it isessential to evaluate how useful it is to relate to the companys policytowards sustainable development. For any company, economic growth has been considered as a major indicatorof a healthy society, but lately, the environmental cost has been recognised bythe society. So there is a need to develop sustainable development a meansof satisfying present needs without compromising the ability of the futuregenerations to meet theirs. The implementation of sustainable managementinitiatives has been mainly a reaction to environmental pressures, legalobligations, risk management, customer demands and competition. This has leadto a change in the stakeholders interpretation of sustainable developmentthrough constraints of politics, economics, science, culture and religion. The intent of an EMS is to facilitate a voluntary implementation of aneffective management system for both sound environmental performance and alsoparticipation in environmental schemes. The design principle of an EMS is notto be a regulatory device as such, but as a regulatory device with the objectiveof sustainable development. To evaluate their role in sustainable development,in their current form, EMS only functions for continual improvement onenvironmental objectives and targets after considering regulations, effects ofthe products on the environment, organisational goals and views of concernedparties. Through compliance, they provide ways to make achievement of that end more sustainable and predictable. Child abuse is a global problem, which unfortunately happens in every society, culture and communities. The term ââ¬Å"Child Abuseâ⬠refers to intended acts that result in physical or emotional harm to children. Child abuse covers a wide range of behavior from physical assault by parents or other adult caretakers to neglect of childââ¬â¢s basic need. Child abuse is a social problem that affects millions of children each year, children less than 3 years of age being the most frequent victims. (Edelman & Mandle, 2010) For this article, the author chose to discuss child abuse and maltreatment in preschool age children. There are many forms of child abuse such as sexual abuse, physical abuse, verbal abuse, emotional abuse, neglect and abandonment/ separation. In this age most common abuses are physical, sexual, emotional and negligence. As a health care provider when we are assessing a case of child abuse, we always need to check the background of the childââ¬â¢s family child, by checking parenting skills of caretakers, employment and education status of the parents, financial conditions at home and environment of the house (safe and clean for the child). We also need to check for any history of drug and alcohol abuse among family members, care takerââ¬â¢s personal limitations and certain cognitive or medical conditions (such as mental retardation or depression) of care takers, all these can effect childââ¬â¢s care tremendously. (Jarvis, 2011) Signs and symptoms nurses need to check for when they are assessing a preschool child for abuse are as follows: Physical Child abuse: Child has unexplained recurrent injuries, burns, fractures, bruises and bald patches. Child shows sign of fear and hesitation during physical exam (he is trying to pull himself away from examiner). Child has difficult time concentrating and shows self-destruction tendencies & aggression towards others. Child is wary of adults and injuries on the body are inconsistent with the childââ¬â¢s age and developmental phase. (Center of Child Protection and Family Support, 2012) Sexual Child Abuse: Child has unusual or excessive itching in the private areas. Genital or anal area is torn, stained or underwear has blood spots. Childââ¬â¢s genital or anal areas could be injured, due to bruising, swelling or infection. Child plays inappropriately with his toys and makes inappropriate drawing according to his age. Suddenly child starts thumb sucking or brings out discarded cuddly toys to play. Child also exhibits a sudden loss of appetite or on the other hand eats compulsively, he starts being isolated orà withdrawn from family/friends and becomes worried when clothing are being removed. Child frequently wets him/herself and often has nightmares. (Center of Child Protection and Family Support, 2012) Emotional Child Abuse: Parents or caretakers frequently yell, threaten or bully the child. They are ignoring the child as a form of punishment, giving him the silent treatment for his needs and also show no signs of affection and love (i.e. hugs kisses and tapping the back). Child shows severe sign of depression, extreme withdrawal or aggression towards other people. Child could be overly compliant with his caretaker orders, too well-mannered and too neat or clean. Child also displays extreme inhibition while playing. Child could have extreme attention seeking behavior or failure to thrive behavior. (Center of Child Protection and Family Support, 2012) Child Neglect: Child has poor personal hygiene, unkempt clothes and hair. Child stays constantly hungry and seems very thin compared to the peer age group. Child has many unattended physical problems or medical needs, eg dental work and glasses. Child is frequently absent from school and forgets his lunch. Child has no social relationship with other kids and shows destructive tendencies. (Center of Child Protection and Famil y Support, 2012) If children been abused by parents and care givers during infancy, toddler and preschool age. They show sign of developmental delay in displaying language, motor and social skills. Abused preschoolers respond to peers and other adults with more aggression and anger than do non-abused children. It is important for the nurse to understand certain cultural health practices that may be misidentified as child abuse. For example In Southeast Asian countries like Laos and Vietnam, people from Mien cultural beliefs in natural healing and use homemade remedies to treat most of the child disease. When a child suffers from restlessness, unremitting crying, agitation, constipation and loss of appetite, parents of the child use string of inner pulp (found in a special reed).The pulp is then dipped lightly in pork fat and lit. The flame is passed quickly over the skin above the pain site, which raises blisters on the skin or sometimes burn the skin which can easily misidentified as child abuse. To cover the blister and burn areas, they use Tiger Balm afterward. Only older person in the family can do this ritual to cure child pain. Any person who has knowledge of or observes a child whom he or she knows or reasonably suspects has been a victim of child abuse or neglect may report the known or suspected instance of child abuse or neglect. (California Department of social services, 2012) Description of report mechanism: Mandated reports of child abuse or neglect must include: â⬠¢ The name, business address, and telephone number of the mandated reporter; â⬠¢ The capacity that makes the person a mandated reporter; and â⬠¢ The information that gave rise to the reasonable suspicion of child abuse or neglect and the source or sources of that information. If a report is made, the following information, if known, also must be included in the report: â⬠¢ The childââ¬â¢s name, childââ¬â¢s address, present location and if applicable childââ¬â¢s school, grade, and class. â⬠¢ The names, addresses, and telephone numbers of the childââ¬â¢s parents or guardians. â⬠¢ The name, address, telephone number, and other relevant personal information about the person or persons who might have abused or neglected the child. Therapeutic relationships and the three stages associated with relationships The whole reason for a therapeutic relationship is to facilitate a successful patient outcome. Each person is unique and has different needs. Stages of development of a therapeutic relationship: Orientation Stageââ¬âinvolves nurses learning about patients and they initial concerns and needs. Patents also learn about the role of the nurse. Patents are informed about the general purpose of taking with the nurse. The initial purpose is plainly: identifying a problem on which you want to work, helping you figure out what has been happening to you lately, or getting to know what has been bothering you. This first stage is about building trust first before moving on to your initial assessment. Afterwards the nurses job is to manage the patients emotions and providing support and structure to the pt. Working Stageââ¬âWhen patients are ready, the work toward changing their thoughts, feelings, and behaviors can begin. However, drastic changes might not be the goal for some patients, particularly the chronically ill. Stabilization with meds, reduction of symptoms, and development of supportive relationships are valid goals. The parts of this working stage begin with in depth data collection. This is where the nurse facilitates awareness, analysis, and interpretation through in-depth exploration of issues and identification of priority issues.
